Bankruptcy

The members of Aronauer & Yudell, LLP regularly appear in bankruptcy courts on behalf of our clients. A large portion of this work involves representing secured creditors when their borrowers file for protection under the Bankruptcy Code. These debtor filings range from small, single-asset cases through extremely large complex cases involving billions of dollars of debt. The work in these bankruptcy cases ranges from prosecuting lift stay applications to cash collateral disputes to filing competing reorganization plans. We have also litigated numerous contested confirmation hearings in bankruptcy court.

In addition to representing secured creditors enforcing their rights, we also represent purchasers of assets from bankruptcy estates and have represented numerous defendants in adversary proceedings.

We regularly represent clients from whom debtors and bankruptcy trustees seek to recover allegedly preferential payments. While the bankruptcy laws strongly favor the debtor’s estate in these proceedings, we have had significant success defending these cases and obtaining settlements on terms favorable to our clients.
